Thomas had just won a racial discrimination settlement against his former employer and went to a TCF Bank branch to deposit the settlement checks. Instead of processing them, a bank employee became suspicious, accused him of attempting fraud, refused the transaction, and called the police. Four officers arrived and questioned Thomas inside the bank while he tried to explain that the checks were legitimate. His attorney later deposited the exact same checks at another bank without any issues, and they cleared successfully.

Believing he had been racially profiled, Thomas filed another racial discrimination lawsuit, this time against the bank. The case drew widespread attention because of the irony: he was allegedly discriminated against while trying to deposit money he had received from a previous racial discrimination case. TCF Bank later apologized for involving the police, though the lawsuit sought damages for the humiliation and emotional distress Thomas said he experienced.
